Dungeons of Chaos Ripping off Crawl Art?

I just picked this game up on my phone for giggles, immediately started noticing hellions, statues, and altars of Sif Muna/oka/chei in the first ten seconds of the opening 'cutscene'.
This distressed me a bit - I've played dcss for an uncomfortable amount of my life and have a huge amount of respect for the game as well as the time artists put in to make these icons. I was upset to see they'd been taken for this guy's game without any sort of credit at all. This game does cost money, it is not free.
Is this kosher? I realize that dcss is free, but I assume the game is protected somehow. Or am I just getting heated about something that isn't a big deal?
